On 8 March 2023 the European Securities and Markets Authority published the official translations of the Guidelines on standard forms, formats and templates to apply for permission to operate a DLT market infrastructure. Guidelines apply to applicants for specific permissions to operate DLT market infrastructures as defined in Article 2(5) of Regulation (EU) 2022/858 of the European Parliament and of the Council of 30 May 2022 on a pilot regime for market infrastructures based on distributed ledger technology, and amending Regulations (EU) No 600/2014 and (EU) No 909/2014 and Directive 2014/65/EU. 

Guidelines apply from 23 March 2023.

In view of the foregoing Urząd Komisji Nadzoru Finansowego (the Polish Financial Supervision Authority) informs that the applications should be sent to the following address: ul. Piękna 20, 00-549 Warszawa, skr. poczt. 419 or via ePUAP to /2447pvjake/SkrytkaESP. The templates must be filled in Polish and English and submitted on a durable medium i.e. on paper or electronically, in a format allowing unchanged reproduction of the information stored.

The application must include the following Tables, filled-in and submitted in line with the Guideline 2: 

• Table 1. General information
• Table 2. Information that should be included in an application for permission to operate a DLT MTF, a DLT SS or a DLT TSS
• Table 3. Application for a permission to operate a DLT MTF or DLT TSS: Exemption(s) to Directive 2014/65/EU and Regulation (EU) No 600/2014
• Table 4. Application for permission to operate a DLT SS or DLT TSS: Exemption(s) to Regulation (EU) No 909/2014
